Terms of Service

These Terms of Service (“Terms”) govern your purchase and use of services from Polery (“we”, “us”). By clicking a Pay button on polery.com or otherwise paying Polery, you agree to these Terms and our Privacy Policy. If you do not agree, do not place an order.

1. What Polery offers

Polery is a small studio that rebuilds websites and syncs online listings for local-service businesses in the United States. Our current paid tiers are:

  • Foundation — $499 (one-time). Mobile-first single-page rebuild · Google/Yelp/Facebook/Instagram sync · 1 year hosting · custom domain (your choice of common TLD such as .com, .io, .shop, etc., or a free Polery subdomain) · full source files · 1 revision round · 30-day post-launch fix window · 3-day delivery.
  • Growth — $899 (one-time). Everything in Foundation, plus a 30-second business video in three formats (9:16, 1:1, 16:9), embedded hero video, email capture form, 2 revision rounds, 5-day delivery.
  • Launch Kit — coming soon. Foundation and Growth buyers are automatically locked in as Founding Customers and receive our biggest discount on Launch Kit and any other future Polery service.

Premium TLDs that cost more than US$50 per year to register (for example .ai) are not included in any tier. You may keep a Polery subdomain at no extra cost.

2. Payment and Merchant of Record

Payments are processed by Creem (Armitage Labs OÜ, Estonia) as our Merchant of Record. Creem handles checkout, card processing, sales tax / VAT, refunds, and chargebacks. The charge on your statement will appear as CREEM.IO or CREEM* POLERY. Prices are shown in US dollars; Creem may add applicable sales tax or VAT at checkout.

All sales are final once we begin work on your project unless you exercise the refund right in §4.

3. What you commit to

  • Provide accurate business details (name, address, hours, services, real photos, real reviews).
  • Respond to questions within a reasonable time so we can meet the delivery window. The delivery clock pauses when we are waiting on you.
  • Not ask us to publish content that is false, misleading, infringing, illegal, hateful, regulated without proper licensing (e.g., medical or legal claims you cannot substantiate), or fraudulent.
  • Confirm you own or are authorized to use everything you send us (photos, logos, copy, business name, domain).

4. Refund policy

Before launch: if the rebuilt site does not feel like your business after the included revision round(s), tell us. We will either fix it within the agreed scope or refund the full project fee within 14 business days. No script, no negotiation.

After launch: refunds are not available once the site is live on your domain, but the 30-day post-launch fix window covers typos, broken links, hours and contact-detail updates at no charge.

5. Revisions

Foundation includes 1 pre-launch revision round; Growth includes 2 pre-launch revision rounds. Additional rounds are billed hourly at our then-current rate. The 30-day post-launch fix window applies to both tiers and covers small corrections, not new feature requests.

6. Delivery

Foundation: targeted 3 business days from the moment you confirm the audit. Growth: targeted 5 business days. The clock starts when we have the materials we need; if you delay sending something we have requested, the clock pauses for that period. Delivery windows are targets in good faith and not guarantees.

7. Hosting, domain, and ownership

Year-one hosting is included on Cloudflare. After year one, you can either continue with Polery (estimated US$5/month) or take the source files anywhere else (Netlify, Vercel, your own server, GoDaddy hosting, etc.).

For tiers that include a custom domain, we register the domain on your behalf in year one. You are the registrant of record; the domain belongs to you. From year two on, you are responsible for renewing the domain at the registrar’s then-current rate, or letting it lapse.

All source files (HTML, CSS, JS, assets) for your project are delivered to you and are yours to keep, modify, and re-host. Polery retains the right to display the project in its portfolio, demo gallery, and case studies, with your business name and a link to your live site.

8. No guaranteed results

We build and prepare marketing assets carefully. We do not guarantee search rankings, lead volume, sales, review volume, platform approval, social-media follower growth, or any specific business outcome. We do not provide legal, financial, tax, medical, or other professional advice.

9. Limitation of liability

To the maximum extent permitted by law, Polery’s total liability under these Terms is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost data, or lost goodwill. Some jurisdictions do not allow these limits, in which case they apply to the maximum extent allowed.

10. Indemnification

You agree to indemnify and hold Polery harmless from claims arising out of (a) content, photos, claims, or materials you provided to us; (b) your business operations; (c) your violation of these Terms or applicable law.

11. Termination

Either side can end the relationship in writing before the project is delivered. If we terminate for cause (e.g., you ask us to publish illegal content), no refund is due for work completed. If you terminate after we have started work, fees for work completed are non-refundable; the refund right in §4 still applies if the work cannot be brought to a satisfactory state through the included revisions.

12. Governing law and disputes

These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law rules. The parties will first try to resolve any dispute by good-faith email discussion for 30 days. If unresolved, disputes will be brought in the state or federal courts located in Travis County, Texas, and the parties consent to personal jurisdiction there. The losing party in any litigation bears the prevailing party’s reasonable attorneys’ fees.

13. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above always reflects the current version. Material changes that affect ongoing customers will be communicated by email to the address on file. Continued use of Polery after a change means you accept the updated Terms.
