Terms of Service

These Terms of Service (“Terms”) govern your purchase and use of services from Polery (“we”, “us”). By requesting checkout on polery.com, completing payment, or otherwise paying Polery, you agree to these Terms and our Privacy Policy. If you do not agree, do not place an order.

1. What Polery offers

Polery is a small studio that rebuilds websites and prepares online launch assets for local-service businesses in the United States. Our current self-serve paid tiers are:

Launch Kit is application-only and not available through self-serve checkout. Launch Kit may include brand starter design, logo design, industry-specific design materials such as restaurant menus or beauty/nail flyers and brand collateral, extra short videos, and launch-push assets. If we approve a Launch Kit scope, we will confirm the written scope, price, payment link, delivery window, and revision terms before work starts. Foundation, Growth, and standalone video buyers are automatically locked in as Founding Customers and receive our biggest available discount on Launch Kit and any other future Polery service.

Premium TLDs that cost more than US$50 per year to register (for example .ai) are not included in any tier. You may keep a Polery subdomain at no extra cost.

2. Payment and processor

Payments are processed by PayPal. PayPal handles checkout, payment-method details, receipts, refunds, and disputes through its payment platform. Polery is the seller of record for the services described here and remains responsible for delivery, project support, and required business records. Prices are shown in US dollars.

All sales are final once we begin work on your project unless you exercise the refund right in §4.

4. Refund policy

Before delivery: for Foundation and Growth, if the rebuilt site does not feel like your business after the included revision round(s), tell us. For the standalone video, the same applies before the final MP4 is delivered. We will either fix it within the agreed scope or refund the full project fee within 14 business days. No script, no negotiation.

After delivery: refunds are not available once a website is live on your domain or, for the standalone video, once the final MP4 has been delivered. For Foundation and Growth, the 30-day post-launch fix window still covers typos, broken links, hours and contact-detail updates at no charge.

5. Revisions

Foundation includes 1 pre-launch revision round; Growth includes 2 pre-launch revision rounds; the standalone video includes 1 revision round plus free fixes for typos, phone, or business hours. Additional rounds are billed hourly at our then-current rate. The 30-day post-launch fix window applies to both website tiers and covers small corrections, not new feature requests.

6. Delivery

Foundation: targeted 3 business days from the moment you confirm the audit. Growth: targeted 5 business days. Standalone video: targeted 2 business days from the moment we have your photos and details. The clock starts when we have the materials we need; if you delay sending something we have requested, the clock pauses for that period. Delivery windows are targets in good faith and not guarantees.

7. Hosting, domain, and ownership

Year-one hosting is included on Cloudflare. After year one, you can either continue with Polery (estimated US$5/month) or take the source files anywhere else (Netlify, Vercel, your own server, GoDaddy hosting, etc.).

For tiers that include a custom domain, we register the domain on your behalf in year one. You are the registrant of record; the domain belongs to you. From year two on, you are responsible for renewing the domain at the registrar’s then-current rate, or letting it lapse.

All source files (HTML, CSS, JS, assets) for your project are delivered to you and are yours to keep, modify, and re-host. Polery retains the right to display the project in its portfolio, demo gallery, and case studies, with your business name and a link to your live site.

8. No guaranteed results

We build and prepare marketing assets carefully. We do not guarantee search rankings, lead volume, sales, review volume, platform approval, social-media follower growth, or any specific business outcome. We do not provide legal, financial, tax, medical, or other professional advice.

9. Limitation of liability

To the maximum extent permitted by law, Polery’s total liability under these Terms is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost data, or lost goodwill. Some jurisdictions do not allow these limits, in which case they apply to the maximum extent allowed.

10. Indemnification

You agree to indemnify and hold Polery harmless from claims arising out of (a) content, photos, claims, or materials you provided to us; (b) your business operations; (c) your violation of these Terms or applicable law.

11. Termination

Either side can end the relationship in writing before the project is delivered. If we terminate for cause (e.g., you ask us to publish illegal content), no refund is due for work completed. If you terminate after we have started work, fees for work completed are non-refundable; the refund right in §4 still applies if the work cannot be brought to a satisfactory state through the included revisions.

12. Governing law and disputes

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules. The parties will first try to resolve any dispute by good-faith email discussion for 30 days. If the dispute is still unresolved, it will be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in English and, where practical, by document submission or video conference rather than an in-person hearing. The losing party in any arbitration or litigation bears the prevailing party’s reasonable attorneys’ fees.

13. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above always reflects the current version. Material changes that affect ongoing customers will be communicated by email to the address on file. Continued use of Polery after a change means you accept the updated Terms.
